FORMER BRUIN O’BANNON TO FIGHT THE NCAA — Former UCLA basketball player Ed O’Bannon yesterday filed a class-action lawsuit in U.S. District Court in S.F. “on behalf of all current and former Division I-A football and men’s basketball athletes against the NCAA,” according to Dan Wetzel of YAHOO SPORTS. O’Bannon alleges that “the NCAA ‘has illegally deprived former student-athletes’ from ‘myriad revenue streams’ including DVDs, video games, memorabilia, photographs, television rebroadcasts and use in advertising.” The main point in the lawsuit is that O’Bannon “never gave the NCAA the right to do such a thing.” Lead co-counsel Michael Hansfeld said, “There was no contractual or other granting of the right by a former student-athlete to the NCAA or any of the universities or conferences to capitalize on the use and licensing of former student-athlete’s images.” NCAA Managing Dir of PR & Media Relations Bob Williams: “We haven’t had an opportunity to review the lawsuit so we will defer comment at this time. However, the NCAA categorically denies any infringement on former or current student-athlete likeness rights.” Wetzel noted if the NCAA were to lose the case it would “either have a growing revenue stream dry up or in a groundbreaking switch be forced to share it with former players (the way professional leagues do).” However, O’Bannon is “not arguing for payment to current players.” O’Bannon: “When you’re in school you’re obligated to live up to your scholarship. But once you’re done, you physically, as well as your likeness, should leave the university and the NCAA” (SPORTS.YAHOO.com, 7/21). O’Bannon has posted an entry at LostLettermen.com detailing his decision to file the lawsuit.
